Administrative Rules

Subject: Dual Employment AR# 6.06.003
Based on Board Policy: F-6, Staffing
Recommended by Council/President: Administrative Services Council
Date Approved/Amended: 09/15/2004

Values

ACC values the talents of its faculty and staff and appreciates that many employees have the expertise and the desire to contribute to the College in more than one official employment capacity.  However, employees are expected to first fulfill the duties and responsibilities of the primary assignment for which they were hired.

Purpose

The College will only allow dual employment at the institution within the guidelines of this Administrative Rule and in compliance with ACC policies as well as all applicable federal and state laws and regulations.

Any employee may be considered for other positions within the College, subject to all applicable College policies, rules, and procedures provided the dual assignment does not overlap or conflict with the primary work assignment or result in overtime pay.  The appropriate Vice President may approve an exception to this policy in special documented circumstances.

Applicability

1.  Hourly Employees -   Hourly employees may be employed in dual assignments in the College, but may not work more than 40 hours per week, not to exceed 900 hours per fiscal year, in the combined positions.  Hourly employees may not work overtime, except in special circumstances approved by the next level supervisor.

2.  Classified Employees - A staffing table, full-time Classified employee scheduled to work forty (40) hours per week may not work in an hourly position in the College.  A Classified employee may work as an adjunct faculty member or teach in Continuing Education, as long as the rate of pay of the dual assignment is equivalent or greater than the overtime rate of the primary classified position, and providing that teaching qualifications are met.

3.  Classified Employees - A staffing table, full-time Classified full-time employee may participate in proctoring standardized tests (such as GED) if the employee is paid directly by the contractor or if the rate of pay for the proctor position is equivalent or greater than the overtime rate of the primary classified position.

4. Classified Employees - A regular part-time Classified employee may hold an hourly position as long as the combined hours of work are 40 hours per week or less.  The part-time classified position is the primary assignment and the employee may work overtime in that position with the approval of the next level supervisor.  The employee may not work overtime in the hourly assignment.

5.  Professional-Technical/Administrator/Full-Time Faculty – A Professional-Technical employee, full-time faculty or administrator may work in any other position within the College as long as the position does not overlap or conflict with the regular schedule of the primary position.

6.  Employees may not use leave time to work in a dual assignment position.

Responsibilities

1.  The employee is responsible for notifying the immediate supervisor of the primary assignment of any dual employment assignment.

2.  HR Payroll is also responsible for notifying a supervisor if the employee is working in a dual assignment that overlaps or the employee accrues overtime as a result of the dual assignment.
