Special Meeting - Board of Trustees

May 7, 2002

 

In accordance with the terms and provisions of the Texas Open Meetings Act, Chapter 551 of the Texas Government Code, the Board of Trustees of the Austin Community College District convened in public session on Tuesday, May 7, 2002, at 6:00 p.m. in the Board Room (201) of the Highland Business Center of the Austin Community College located at 5930 Middle Fiskville Road, Austin, Texas, with the following members present: Lillian Davis, Chair/Presiding Officer; Beverly S. Silas, Vice Chair, John Worley, Secretary; Allen Kaplan, Della May Moore [arrived at 6:15 p.m.]; and Rafael Quintanilla.  Trustees Beverly Watts Davis and Carol Nasworthy were absent from the meeting.

 

It is further found and determined that in accordance with the policies and orders of this Board, the notice of this meeting has been posted and return thereof made pursuant to the terms and provisions of the Texas Open Meetings Act, Chapter 551 of the Texas Government Code, and there has been full compliance with the terms and provisions of said act, including the timely posting of the subjects of this meeting.

Dr. Davis introduced the item and recognized Rose Sarrett-Sickel, Deputy City Clerk, City of Austin.  Ms. Sarrett-Sickel distributed information and provided the results of the May 1, 2002, general election for Places 1, 2, and 3 of the Austin Community College Board of Trustees:

MOTION:  The Board of Trustees approve the Resolution canvassing the votes and  declaring the results of the May 4, 2002, election.

VOTE:  The motion passed on a unanimous vote of 7-0.  A copy of the Resolution Canvassing the Returns and Declaring the Results of the May 4, 2002, General Election of the Austin Community College District is attached and incorporated herein by reference.

Trustees Beverly Watts Davis and Della May Moore were absent from the meeting.

A RESOLUTION CANVASSING THE RETURNS

AND DECLARING THE RESULTS

OF THE MAY 4, 2002, GENERAL ELECTION

OF THE AUSTIN COMMUNITY COLLEGE DISTRICT

 

            WHEREAS, the Board of Trustees ("Board") of the Austin Community College  District (“District”) called a General Election to be held on May 4, 2002, for the purpose of electing trustees to serve six-year terms for places one (1), two (2) and three (3); and

            WHEREAS, the Board has reviewed and investigated all matters pertaining to this election, including the calling, notices, election officers, holding, and reports thereof under the Joint Election Agreement with the City of Austin, Austin Independent School District, Barton Springs/Edwards Aquifer Conservation District, Leander Independent School District and Manor Independent School District; and

 

            WHEREAS, the Board  hereby canvasses the returns of this election, at which there was submitted to all resident, qualified electors of the District who also reside within Travis County and Williamson County, for their vote, the following candidates:

            WHEREAS, from these returns, the Board hereby finds that the following votes were cast in the election by voters who were resident, qualified voters in Travis County and Williamson County Area of the District:

            NOW, THEREFORE, it is accordingly found, declared, and resolved by the Board of Trustees of the

Austin Community College District that:

 

            SECTION 1. The Board officially finds, determines, and declares that the election was duly and properly conducted, that proper legal notice of such election was duly given in the English language and the Spanish language (to the extent required by law), that proper election officers were duly appointed prior to the election, that the election was duly and legally held, that all resident, qualified voters of the District in Travis County and Williamson County  were permitted to vote at the election, that due returns of the results of the election had been made and delivered, and that the Board has duly canvassed such returns, all in accordance with the laws of the State of Texas and of the United States of America, and the orders calling the election.

 

            SECTION 2.  A majority of the resident, qualified voters of the Austin Community College District  voted in Place 1for candidate Lillian Davis.   And Lillian Davis is hereby elected.

 

            SECTION 3.  No majority of the resident, qualified voters of the Austin Community  College District voted in Place 2 for any candidate.    Paul Sherr and John Hernandez are hereby in a runoff election.    

           

            SECTION 4.  No  majority of the resident, qualified voters of the Austin Community College District  voted in Place 3 for any candidate.  Nan McRaven and James McGuffee are hereby in a runoff election.                      

 

            SECTION 5.  The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the Board.

 

            SECTION 6.  It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, as amended, Texas Government Code.

 

            SECTION 7.  This Resolution shall be in force and effect from and after its final passage and it is so resolved.

 

            PASSED, ADOPTED AND APPROVED, this the ________ day of May, 2002.

Matters Related to Conduct of May 4, 2002, Board of Trustees Election

Dr. Davis introduced the item and Myra McDaniel, College Legal Counsel, presented the Order Calling the Run-Off Election on June 1, 2002; Run-Off Election Early Voting Polling Places; Run-Off Election Early Voting Polling Places (Spanish); Run-Off Election Day Polling Places; and Run-Off Election Day Polling Places (Spanish).  Ms. McDaniel and and Linda Young, Special Assistant to President, responded to questions from Trustees.  Trustees discussed the expected cost of $300,000 for holding the run-off election.  Since the City of Austin and Travis County will not have elections on that date, Austin Community College must pay the full cost of the run-off election.

 

Della May Moore moved and Beverly Silas seconded that:

MOTION:  The Board of Trustees approve the Order calling the June 1, 2002, Run-Off Election, with amendment of Exhibit B to substitute Bowie High School (360) for Covington Middle School (352) and the Additional Branch Early Voting Polling Places to read:  “The Board hereby establishes additional Branch Early Voting Polling Places as set forth on the attached document labeled as ‘Exhibit B’, which is incorporated herein by reference.  Early voting by personal appearance shall be conducted at the such additional Branch Early Voting Polling Places on the dates and at the times set forth in Exhibit B during the period from May 17 19, 2002, through Tuesday, May 28, 2002.”

VOTE:  The motion passed on a vote of 7-0.  A copy of the Order, as adopted, is attached and incorporated herein by reference.

Trustees Beverly Watts Davis and Carol Nasworthy were absent from the meeting.

ORDER CALLING RUNOFF ELECTION

 

            WHEREAS, the Board has canvassed the returns of the General Election held on May 4, 2002, at which there were submitted to all resident, qualified voters of the District for their vote thereupon; and

 

            WHEREAS, The Board determines that no candidate for Trustee for places two (2) and three (3) has received a majority of the votes from resident, qualified voters of the District voting in the election held on May 4, 2002; and

 

            WHEREAS, the Board of Trustees (the "Board") of the Austin Community College District  (“ACC”) has the authority to call a runoff election on June 1, 2002 for trustees to serve six-year terms for places  two (2) and three (3); and,

 

            WHEREAS, the Board also has the authority pursuant to Chapter 31, Texas Election Code, to enter into a contract to perform election services with Travis County;

 

            IT IS, THEREFORE, ORDERED BY THE BOARD OF TRUSTEES OF THE AUSTIN COMMUNITY COLLEGE DISTRICT THAT:

 

Section 1.  Call of Runoff Election: Date: Eligible Electors: and Hours.  A runoff election (the "Election") shall be held on Saturday, June 1, 2002, within the entire territory of ACC for trustees to serve six-year terms for places two (2) and three (3), at which all resident, qualified electors of ACC shall be entitled to vote for candidates for the school board trustee positions at issue.  The Board hereby finds that holding the Election on such date is in the public interest.  The hours during which the polling places are to be open at the Election shall be from 7:00 a.m. to 7:00 p.m.

A list of all of ACC’s  voting precincts is included in the document attached to this Order and labeled as “Exhibit A”, which is hereby incorporated by reference as if fully set out in the body of this Order.

 

 

Section 2.  Conduct of Election, Joint Election Agreement and Appointment of Election Officers.  The Election shall be conducted by election officers, in accordance with the Texas Education Code, the Texas Election Code and the Constitution and laws of the State of Texas and the United States of America.  Paper ballots described and defined in the Texas Election Code shall be utilized for the election.

 

Section 3.  Appointment of Custodian of Records.  The Board appoints Linda Young, an employee of the ACC, as the Custodian of Records ("Custodian") and agent to the Board Secretary to perform the duties related to the conduct and maintenance of records of the Election as required under the Texas Election Code.  In particular, the Custodian shall determine the order in which names will appear on the ballot for the trustee positions and accept and maintain records regarding campaign expenditures that may be filed with ACC.

 

Section 4.  Early Voting by Mail.  The Board appoints Linda Young as ACC’s Regular Early Voting Clerk.  Ballot applications and ballots voted by mail shall be addressed to ACC’s Regular Early Voting Clerk at the address indicated immediately below.

The Regular Early Voting Clerk for ACC shall collect all applications for ballots received by ACC at the above address during the period allowed by the Texas Election Code and shall deliver all such applications to the Voting Clerk.

 

Section 5.  Early Voting.  The Voting Clerk for all purposes other than accepting applications for ballots by mail shall be under the terms of the contract to perform election services.

 

Main Early Voting Polling Place

 

The Main Early Voting Polling Place is hereby designated as:

 

                        Austin Recreation Center

                        1301 Shoal Creek

                        Austin, Texas

 

Early voting by personal appearance shall be conducted at the Main Early Voting Polling Place from 8:00 a.m. until 5:00 p.m. on Monday through Friday, May 20-24, 2002 ; and from noon to 5 p.m. on Sunday, May 19, 2002, and on Tuesday, May 28, 2002 from 8:00 a.m. until 5:00 p.m.  The Main Early Voting Polling Place shall also remain open on the day of the Election during the hours the polls are required to be open for voting by the Texas Election Code.

 

Additional Branch Early Voting Polling Places

 

            The Board hereby establishes additional Branch Early Voting Polling Places as set forth on the attached document labeled as "Exhibit B," which is incorporated herein by reference.  Early voting by personal appearance shall be conducted at the such additional Branch Early Voting Polling Places on the dates and at the times set forth in Exhibit B during the period from May 19, 2002, through Tuesday, May 28, 2002.

 

Early Voting Ballot Board

 

            The Board hereby authorizes the Chair of the Board to appoint a person to act as the presiding judge of the early voting ballot board to count and return early voting ballots in accordance with the Election Code.  The presiding judge shall appoint two or more election clerks, and such judge and clerks shall constitute the early voting ballot board and shall perform the duties set forth for such board in the Election Code.

           

            Section 6.  Delivery of Voted Ballots; Counting.  In accordance with the requirements of the Texas Election Code, after the close of voting on election day, the presiding election judges for each respective precinct shall deliver the ballot boxes for their respective precinct to the Central Counting Station.  The early voting ballot board, at a time and in the manner permitted under the Texas Election Code, shall deliver the early voting ballots to the Central Counting Station for counting.

 

Section 7.  Canvassing of Returns: Declaring Results.   The Custodian shall make a written return of the Election results to the Board in accordance with the Election Code.  The Board shall canvass the returns and declare the results of the Election.

 

            Section 8.  Authorization to Execute.  The Chair of the Board is authorized to execute and the Secretary of the Board is authorized to attest this Order on behalf of the Board; and the Chair of the Board is authorized to do all other things legal and necessary in connection with the holding and consummation of the Election.

 

Section 9.  Effective Date.  This Order is effective immediately upon its passage and approval.
