In accordance with the terms and provisions of the Texas Open Meetings Act, Chapter 551 of Texas Government Code, the Board of Trustees of the Austin Community College District convened in public session on Monday, July 7, 2003, at 6:02 p.m. in the Board Room (201) the Highland Business Center of Austin Community College located at 5930 Middle Fiskville Road, Austin, Texas, with the following members present: Rafael Quintanilla, Chair/Presiding Officer; Barbara P. Mink, Board Vice Chair; Allen H. Kaplan, Secretary; Lillian Davis; Nan McRaven; and John Worley.  Trustees Beverly Watts Davis, John Hernandez, and Beverly Silas were absent.

 

It is further found and determined that in accordance with the policies and orders of this Board, the notice of this meeting has been posted and return thereof made pursuant to the terms and provisions of the Texas Open Meetings Act, Chapter 551 of the Texas Government Code, and there has been full compliance with the terms and provisions of said act, including the timely posting of the subjects of this meeting.

·        Financial Report – April 2003 – Ben Ferrell, Vice President for Business Services, called attention to the May 2003 monthly financial report and detailed year-to-date expenditures and revenues against the budget and a monthly revised fiscal-year projection of expenditures and revenues.  He stated the College will have a positive balance of revenues versus expenditures for the current fiscal year and that the College will meet the expectations of the minimum reserves level policy (G-6) or the corrective action plan requirements.  Mr. Ferrell responded to questions from Trustees.

Proposed Revision of Board Policy E-1, Master Planning

Recommendation:  That the Board of Trustees approve the proposed revision of Policy E-1, Master Planning.

E-1. MASTER PLANNING

The President shall develop, in document form, for biennial review and approval by the Board of Trustees, a comprehensive College Master Plan that encompasses the needs of the entire institution with specific attention given to educational, financial, and physical development planning that leads the College toward achievement of its mission/vision.  The Master Plan should incorporate program and institutional improvements that increase student success and provide quality learning experiences and services to students and the community. The College Master Plan shall be based upon determinations of current and future community needs and upon responsible utilization of fiscal, physical, and human resources.  The Board policies on Intended Results and Mission of the College shall be used as the foundation for College planning efforts.

A. Principles:

The Master Plan, and the process used to develop it, shall adhere to the following planning principles:

[1] The main focus of ACC's planning shall be to ensure that the regular activities of the College match community needs and are effective in enabling students, local employers, and the community sectors to reach their declared educational goals efficiently. Care must be taken in the planning process to ensure that new initiatives and current activities both have adequate, equitably-distributed resources.

[2] The accessibility of ACC to students who have few other educational options must be a pervasive concern in all College planning. Since any ineffective use of resources may directly lead to higher student tuition rates, the College must operate with exemplary efficiency to maximize student access and success and to avoid abuse of ACC's state and local tax subsidies.

[3] The College shall provide efficiently-delivered high-quality instruction that closely matches student and community needs and enables rapid student progress to competence in their chosen fields. The College shall minimize requirements that are not essential to meet a student's declared educational goals. The College shall systematically provide the support needed for sustained high-quality instruction that develops the work habits and problem-solving skills needed for successful employment and educational advancement.

[4] The planning process shall ensure compliance of College operations with Board policies and accreditation criteria.

[5] Institutional research must be an integral part of the College's planning and evaluation processes, and there must be a clear linkage between planning, budgeting, evaluation, and assessment.  The Master Plan must incorporate performance measures for and provide evidence of program and institutional improvement based on the results of assessment.

[6] The planning process shall include recommendations from the instructional task forces, faculty, and staff.

[7] The planning process shall be open, with public access provided to the information on which plans are based and to the recommendations made at each stage of the planning process.

[8] As part of the planning process, the administration shall identify potential instructional programs with substantial enrollment at other local institutions that are not offered at ACC but are within its legal scope.

B. Board Input Role

During each cycle of updating the Master Plan, the Board shall, after considering planning information and recommendations provided by the administration, adopt a set of planning directives, including those listed here, stating the elements it wishes to emphasize.

[1] For programs in which local tuition/fees and state-reimbursement revenues cover overall costs (including indirect, facility, and capital costs), the extent of program offerings shall be determined primarily by student demand. Programs requiring significant subsidy shall be offered in accordance with a community-priorities declaration adopted by the Board, which shall be based on consideration of local workforce and higher-education needs, and adopted by the Board.

[2] The Board will, in response to Presidential recommendations based on policy F-10, adopt specific compensation goals as part of its update of the College's master plan. During that review, the Board shall be provided information comparing College compensation rates to those typical of both the primary comparison groups and various other groups of employers that might be considered relevant. Information shall also be provided comparing the workloads and compensation of full-time and adjunct faculty at the College.

Proposed Revision of Board Policy D-2, Academic Freedom and Responsibility

Recommendation:  That the Board of Trustees approve the proposed revisions to Board Policy D-2, Academic Freedom and Responsibility.

D-2. ACADEMIC FREEDOM AND RESPONSIBILITY

 

[1] Institutions of higher education are conducted for the common good. The

common good depends upon a free search for truth and its free expression. Hence

it is essential that faculty members at Austin Community College be free to

pursue scholarly inquiry without unreasonable restriction, and to voice and

publish their conclusions without fear of institutional censorship or

discipline. They must be free from the possibility that others of differing

vision, either inside or outside the college community, may threaten their

professional careers.

 

[2] Opportunity for a students to examine and question the pertinent data and assumptions of a given discipline, guided by the evidence of scholarly research, is appropriate in a learning environment.  This concept right is accompanied by an equally demanding concept expectation of responsibility on the part of the student.

 

[3] The concept of academic freedom in Austin Community College is accompanied

by an equally demanding concept of responsibility, shared by the Board of

Trustees, administration, and faculty members and students.

 

[4] The essential responsibilities of the Board of Trustees and administrators

regarding academic freedom are set forth in the Criteria For Accreditation,

adopted by the Southern Association of Colleges and Schools, as updated and

revised.

 

[5] In the classroom or in College-produced telecommunications, faculty members

should strive to be accurate, to exercise appropriate restraint, and to show

respect for the opinions of others. In addition, instructors should be judicious

in the use of material and should introduce only material that has a clear

relationship to the subject field.

MOTION:  The Board of Trustees approve the proposed revisions to Board Policy G-7, Property Taxes.

VOTE:  The motion failed on a vote of 2-4.

FOR:  Allen Kaplan and John Worley.

AGAINST:  Lillian Davis, Nan McRaven, Barbara Mink, Rafael Quintanilla.

Trustees Beverly Watts Davis, John Hernandez, and Beverly Silas were absent from the meeting.

Agenda Item 7740

Order Ratifying and Approving the Annexation of Manor Independent School District into the Austin Community College District for Junior College Purposes

Chair Rafael Quintanilla introduced the item and Myra McDaniel, College Legal Counsel, stated that no formal Resolution was adopted by the Austin Community College Board of Trustees at the time of Manor Independent School District annexation and approval of a Resolution was needed for issuing the bonds.

Trustee Barbara Mink moved and Allen Kaplan seconded that:

MOTION:  The Board of Trustees approve an Order Ratifying and Approving the Annexation of Manor Independent School District into the Austin Community College District for Junior College Purposes.

VOTE:  The motion passed on a vote of 6-0.

ORDER RATIFYING AND APPROVING THE ANNEXATION

OF THE MANOR INDEPENDENT SCHOOL DISTRICT INTO THE

AUSTIN COMMUNITY COLLEGE DISTRICT

FOR JUNIOR COLLEGE PURPOSES

WHEREAS, on November 3, 1998, the voters of Manor Independent School

District (“Manor ISD”) voted to authorized the annexation of the territory of Manor ISD

to Austin Community College for junior college purposes; and,

 

WHEREAS, on November 9, 1998, the Travis County Commissioners Court

canvassed the returns of the November 3, 1998 annexation election and declared the

territory of Manor ISD annexed to Austin Community College District for junior college

purposes and transmitted that canvassing order to the Board of Trustees of Austin

Community College District; and,

 

WHEREAS, the territory of Manor ISD has been annexed and incorporated into

the territory of the Austin Community College District for junior college purposes from

the time of that election to the present; and,

 

WHEREAS, the District duly acknowledged the addition of the Manor ISD into

the Austin Community College at its regular meeting on December 7, 1998; and,

 

WHEREAS, the District is required to acknowledge and concur in the annexation

of this territory for junior college purposes by order under Tex. Educ. Code Section

130.065(g).

 

IT IS THEREFORE ORDERED, by the Board of Trustees of Austin Community

College that it acknowledges and concurs with the order of November 9, 1998 of the

County Commissioners Court of Travis County declaring the territory of Manor ISD

officially annexed to the Austin Community College District for junior college purposes

effective concurrently beginning on November 9, 1998, and that the boundaries of the

District are redefined, enlarged and extended to incorporate the territory of Manor ISD.

 

THE BOARD FURTHER FINDS AND DETERMINES, that the meeting at which

this Resolution is adopted was open to the public; and that public notice of the time,

place, and purpose of such meeting was given, all as required by Chapter 551, Texas

Government Code, as amended

 

PASSED, ORDERED, ADOPTED by the Board of Trustees of the Austin

Community College District on this the 7th day of July, 2003.

Discussion of FY 04 Budget

Mr. Quintanilla introduced the item and Ben Ferrell, Vice President of Business Services, distributed  the additional information requested by Trustees and called attention to the current draft of the Fiscal Year 2004 budget.  Trustees discussed the proposed Fiscal Year 2004 budget including parking fees;  a tuition increase; compensation goals; stipends; Early College Start program; Honeywell energy audit; Master Plan funding guidelines; College reserves; numbers for capital outlay and technology items; advertising expenditures.  Trustees requested additional information on the proposed Fiscal Year 2004 budget.

Proposed Revision of Board Policy A-4, Tuition Rates

Chair Rafael Quintanilla introduced the item and Trustees discussed the proposed revisions to Board Policy A-4, Tuition Rates.  Trustees discussed the need for revision of the policy to have a balance in the policy that talks about tuition rates in terms of the cost of education and the revenue-based model as recommended in the State Comptroller’s report.  The proposed revision of Board Policy A-4 would take both of these into consideration as tuition rates are set, and the difference between in-district and out-of-district tuition.  Trustees discussed the need for additional information on adult education, Early College Start, scholarships/tuition waivers, actual cost of housing for an efficiency apartment in Austin area/HUD rate, and a greater breakdown of the proposed advertising expenditures.  Trustees requested that this item be scheduled for a lengthy discussion at a future Board meeting.

Proposed Approval of Tuition and Fees for Fiscal Year 2004

Chair Rafael Quintanilla introduced the item.

Trustee Lillian Davis moved and Barbara Mink seconded that:

MOTION:  The Board of Trustees raise tuition by $2 per credit hour and raise the building fee by $1 per credit hour beginning with the 2003 fall semester for in-district and out-of-district students.

 

Trustee John Worley moved and Allen Kaplan seconded that:

SUBSTITUTE MOTION: The Board of Trustees raise the building fee by $1 for all students, raise tuition by $2 for all in-district students; and raise tuition for all out-of-district students by $5.

 

VOTE ON SUBSTITUTE MOTION:  The motion failed on a vote of 3-3.

FOR:  Allen Kaplan, Nan McRaven, John Worley.

AGAINST:  Lillian Davis, Barbara Mink, Rafael Quintanilla.

Trustees Beverly Watts Davis, John Hernandez, and Beverly Silas were absent from the meeting.

 

VOTE ON ORIGINAL MOTION:  The motion passed on a vote of 5-1.

FOR:  Lillian Davis, Allen Kaplan, Nan McRaven, Barbara Mink, and Rafael Quintanilla.

AGAINST:  John Worley

Trustees Beverly Watts Davis, John Hernandez, and Beverly Silas were absent from the meeting.

 

Dr. Barbara Mink moved and Dr. Lillian Davis seconded that:

MOTION:  That the Board of Trustees approve the course fee structure proposed on pages 81-90 of the agenda.

VOTE:  The motion passed on a vote of 6-0.

FOR:  Lillian Davis, Allen Kaplan, Nan McRaven, Barbara Mink, Rafael Quintanilla, and John Worley.

AGAINST:  None.

Trustees Beverly Watts Davis, John Hernandez, and Beverly Silas were absent from the meeting.

Allen Kaplan moved and Rafael Quintanilla seconded that:

MOTION:  The Board of Trustees raise the parking fee to $25 for students and $10 for employees.

Trustees discussed the proposed parking fees.

Mr. Kaplan withdrew the motion and requested additional information regarding parking,

 

Agenda Item 7737

Proposed Revision of Board Policy C-3, Duties and Responsibilities, College President

Chair Rafael Quintanilla introduced the item and Trustees discussed the proposed revisions. 

Allen Kaplan moved and Nan McRaven seconded that:

MOTION:  The Board of Trustees approve the proposed revisions to Board Policy C-3, Duties and Responsibilities, College President, with an added revision: “[4]:  Creates, organizes, and/or reorganizes manages with 30 days prior notice with the approval to the Board of Trustees for major changes to the administrative organization of the College and manages the administrative organization of the College.”

Trustees discussed the need for comments from the College’s shared governance group and comments from the Southern Association of Colleges and Schools (SACS).

Mr. Kaplan withdrew the motion.

 

Agenda Item 7738

Proposed Revision of Board Policy E-4, Organizational Performance Evaluation/Auditing

Chair Rafael Quintanilla introduced the item.  Trustees reviewed and discussed the proposed changes.  Dr. Fonte requested an additional revision to the President’s proposed revisions to read, in paragraph 4, “The President shall consider all activities suggested by Board members and assign them to the Internal Auditor or to other appropriate staff of the College, including the President, him/herself, or and provide a report to the Board providing reasons why the activity is inappropriate for review by a College staff member.”

 

Trustees discussed a proposed change to the last sentence of the third paragraph:  The President shall provide to the Board a copy of the annual work plan of the Internal Auditor and any other additions in a timely manner.  Trustees also discussed possible wording for use of the External Auditor. 

 

The College shared governance group was asked to provide comments regarding this item.  Trustees were requested to submit any suggested revisions to Dr. Fonte.  This item will be included on the agenda of the August 4 Regular Board meeting.

Discussion of Board Policy G-5, Capital Equipment Projects

Chair Rafael Quintanilla introduced the item and stated that this item was included on the agenda to make people aware publicly that this was an area where he might be looking to amend the budget.

Announcements

Dr. Mink announced that the Request for Proposal for Presidential Search Services is on the College’s web page.  She stated the deadline for receipt of proposals is July 25, 2003, in the Purchasing Department.  Dr. Mink advised that she, Nan McRaven, and Allen Kaplan will review the proposals along with two representatives from each employee association, the Student Government Association, the affiliate associations, and two College administrators.  The review will occur on the afternoons of July 28 and July 29 in the Service Center.  This will be an opportunity for multiple input on the RFPs to make an informed choice on the Search Firm.  Information will be updated on the web page.

 

Meeting Review

Trustees commented regarding the meeting: 

What we did well:  Excellent meeting; covered a whole lot of ground, and that’s a good thing; liked the way the meeting was started and really opened it up and really allowed time to focus on the budget and gave the Board good time to do that; this was a good meeting and glad to see that people are beginning to understand that this is not the same old budget process, think we are clearly digging deeper and looking at things that we haven't looked at in the past—and I think that’s good and we need to continue that process; really enjoyed the meeting tonight and also enjoyed having community input and wish that it would not just occur when there was something negative going to happen, really wish that we had more issues and community involvement and citizens would come to speak to us about issues of interest to them, not sure how we generate that or how we let the community know that we are here--because we deal with really important issues and would like to hear from more citizens and more groups about how they feel.

What we can do better:  It is very difficult to do important business when three of our members are not here;
