COURSE DISCRIPTION:

 

RELE 1211 REAL ESTATE CONTRACTS (2-2-0).  Review of real estate contracts required by Section 6A (3) of the Real Estate License Act with emphasis on general contract law requirements. Also covers the purpose, history, and working process of the Broker-Lawyer Committee. Includes preparation of real estate contract forms with emphasis on the most commonly used forms. Skills: R

COURSE RATIONALE:

 

The purpose of this course is to prepare the student to identify and understand the dynamics of the real estate industry in Texas, to prepare them for licensing exams and/or to provide them with knowledge to understand the importance of marketing real estate and the responsibilities of agents, brokers, and clients.

 

This course will help students develop the understanding and skill necessary to become successful real estate law of contracts in Texas. The course integrates the legal aspects of real estate contract such as elements of a contract, statue of frauds, specific performance, unauthorized practice of law, owner disclosure, and knowledge of the various contract forms. Legal issues are addressed as is the deceptive trade practices and consumer protection issues.

 

Real Estate Law of Contracts is not just about textbook learning; it challenges the student to use their critical and creative skills in all aspects of real estate not just those covered in this text. The student will become aware of how to apply the knowledge and skills learning in this course.

COURSE POLICIES:

 

Departmental policies for Incompletes, Attendance, and Withdrawal are as follows:

 

Incomplete Policy:  An incomplete (I) will be granted to a student in rare circumstances. Generally, to receive a grade of I, a student must have completed all examinations and assignments to date, be passing, and have personal circumstances that prevent course completion that occur after the deadline to withdraw with a grade of W.

 

Attendance Policy:  All students are expected to attend classes.  Non-attendance will have an impact on the student’s grade.

 

Withdrawal Policy:  It is the student’s responsibility to withdraw from a course.  Instructors are allowed to withdraw students but students must not rely on their instructor to withdraw them if they wish to withdraw.

Academic Freedom Statement:  Each student is strongly encouraged to participate in class. Academic work submitted by students shall be the result of their thought, research or self-expression. Academic work is defined as, but not limited to tests, quizzes, whether taken electronically or on paper; projects, either individual or group; classroom presentations, and homework” (see Student Handbook). Penalties for scholastic dishonesty will depend upon the nature of the violation and may range from lowering a grade on one assignment to an F in the course and/or expulsion from this institution.

 

Student Discipline Statement:  Classroom behavior should support and enhance learning. Behavior that disrupts the learning process will be dealt with appropriately, which may include having the student leave class for the rest of that day. In serious cases, disruptive behavior may lead to a student being withdrawn from the class. ACC's policy on student discipline can be found in the Student Handbook.
