Title IX

What is Title IX?

The Education Amendments of 1972 states that: No person in the United States shall, on the basis of sex, be excluded from participation in, be denied benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

Title IX applies to all institutions that receive federal financial assistance, including K-12 schools and institutions of higher education.

The U.S. Department of Education Office for Civil Rights enforces Title IX, including investigating and resolving complaints. Additionally, the OCR provides institutions with information and guidance in order to provide support in complying with the law.

What is ACC Sexual Misconduct Policy?

The ACC sexual misconduct policy is articulated in Administrative Rule 3.10.003 and is contained in the ACC Catalog and Student Handbook.

What does the policy cover?

ACC’s sexual misconduct policy addresses all forms of discrimination and harassment based on sex or gender. Examples: Sexual Assault (including unwanted touching), Sexual Harassment (including hostile environment and quid pro quo), Intimate Partner Violence, Sexual Exploitation, Stalking, and Gender Based Harassment.

Who is covered by the policy?

All ACC Students, Employees, Vendors, and Guests.

What is the process for filing a complaint?

Complaints are filed with District Title IX Coordinator or with a Deputy Title IX Coordinator. Complaints can brought forward in writing, via email, phone, or in person.

What is the procedure for addressing complaints?

Title IX complaints are addressed through an investigation process. Complaints can typical resolved formally or informally. Trained investigators are assigned to conduct fact finding regarding the complaint. Both parties in the complaint are offered equal opportunity to present information, call witnesses, have the support of an advisor, and provide information regarding allegations.

  • You do not need to ask questions, just report what is given to you and support the victim

Not all reports will result in a formal investigation. However, all reports must be reviewed and addressed. If you are unsure, report it.

Responsible Employees

  • Employees who are supervisors must report all allegations of sexual misconduct to the District Title IX Coordinator or to a Deputy Coordinator
  • Employees who are not supervisors must report all allegations to the supervisor or directly to the District Title IX Coordinator, or to a Deputy Coordinator
